1. Introduction & Agreement
Welcome to Vestigia, a cultural exploration platform offering interactive maps, community messaging, cultural event calendars, and itinerary planning tools to help users discover and engage with archaeological and cultural sites globally.
Please read these Terms of Service (“Terms”) carefully before using the Vestigia website, mobile app, or any related services (collectively, the “Services”). These Terms form a binding legal agreement between you and Vestigia (“we”, “us”, or “our”).
By accessing, registering for, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

2. Eligibility
To be eligible to use the Services, you must be at least 13 years old (or the minimum legal age required in your country of residence to consent to data processing).
If you are under the age of majority in your jurisdiction, you represent and warrant that you have obtained permission from your parent or legal guardian to access and use the Services, and they agree to be bound by these Terms on your behalf.

3. User Accounts
To access certain features of the Services, you may be required to register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account details to keep them accurate.
- Maintain the security of your password and accept all risks of unauthorized access to your account.
- Promptly notify us if you discover or suspect any security breaches related to your account.
We reserve the right to suspend, disable, or terminate your account at any time at our sole discretion if we determine you have violated these Terms.

Keep your login credentials secure, provide accurate info, and do not share accounts. We can suspend accounts that violate our terms.
5. Affiliate & Sponsored Links
Vestigia participates in affiliate programs through TravelPayouts to help fund the platform. On certain pages (such as wiki guides and editorials), free-tier users may see:
- WeGoTrip — sponsored audio tour and experience listings, linked with affiliate tracking.
- Jetradar — flight search forms that redirect to Jetradar with affiliate attribution.
- Hotellook — hotel search forms that redirect to Hotellook with affiliate attribution.
- Google AdSense — display advertisements in feeds and other surfaces (see our Privacy Policy for cookie rules).
Disclosure:Vestigia may receive a commission when you click a sponsored link from a TravelPayouts affiliate partner and complete a qualifying purchase or booking on that partner's website. This does not increase the price you pay. Partner names and logos are listed in our site footer. Integration partners (such as Ticketmaster for event discovery) are listed separately and are not part of the TravelPayouts affiliate program.
Official tickets vs. affiliate tours:Wiki "Official Tickets" buttons link directly to venue operators and are not affiliate links. Sponsored tour listings are clearly labeled and appear separately in partner widgets.
Vestigia+: Premium subscribers do not see affiliate travel widgets or display ads. See Section 4 for subscription details.
All bookings, cancellations, refunds, and customer support for flights, hotels, and tours are handled solely by the respective partner under their own terms and privacy policies. Vestigia is not a travel agency and is not a party to any transaction between you and a partner.

Some pages show sponsored travel tools and tour listings. We may earn a commission if you book through our partners, at no extra cost to you.
6. Acceptable Use
You are solely responsible for your conduct while using the Services. You agree not to engage in any of the following prohibited behaviors:
- Violating any local, national, or international laws or regulations.
- Uploading, posting, or transmitting content that is offensive, harmful, harassing, defamatory, or infringes on another party's intellectual property.
- Using automated scraping, crawling, or data extraction tools without our prior written authorization.
- Attempting to bypass security systems, disrupt servers, or gain unauthorized access to other user accounts.
- Impersonating another person or entity, or falsifying your affiliation.

Use the app legally and respectfully. Do not spam, scrape content without authorization, spread hate, or hack our systems.
7. Content Ownership & Licenses
You retain all ownership rights in the content you submit, post, or upload to the Services (such as reviews, travel photos, itineraries, and messages).
By posting content, you grant Vestigia a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute your content across our platform and channels.
All other materials on the Services (including software, UI designs, graphics, maps, proprietary descriptions, logos, and curated database records) are owned by or licensed to Vestigia and are protected by copyright and intellectual property laws.

You own the text, photos, and reviews you upload, but you grant Vestigia a license to display them. All other map design and code belong to us.
8. Cultural & Historical Accuracy
Vestigia aims to provide high-quality educational and cultural narratives. However, much of the content is sourced from public APIs (like Wikipedia/Wikimedia) or contributed by our user community.
We do not represent or warrant that all historical, archaeological, geographical, or logistical descriptions are completely accurate, complete, or up to date. We encourage users to submit corrections and help maintain a respectful, accurate exploration resource.

We aim for cultural sensitivity and historical accuracy, but cannot guarantee that all user-submitted or API-derived content is perfectly error-free.
9. Third-Party Services
The Services integrate, link to, or leverage third-party APIs and services, including Stripe (payments), Sketchfab (3D models), OpenStreetMap/MapLibre (maps), Supabase (auth and database), Wikipedia/Wikimedia (content), Google AdSense (advertising), TravelPayouts affiliate partners — WeGoTrip (audio tours), Jetradar (flights), and Hotellook (hotels) — and integration partners such as Ticketmaster (event discovery and ticket links).
These integrations are governed by their respective owners' terms and conditions. We are not responsible for the availability, content, privacy policies, or actions of these external entities.

10. Account Termination
We reserve the right, without notice and at our sole discretion, to terminate or suspend your license to use the Services and block or prevent your future access. Reasons for termination may include, but are not limited to, violations of these Terms or requests by law enforcement.
You may terminate your account and relationship with Vestigia at any time by utilizing the delete account features within your profile settings or by contacting support.

11. Privacy Linkage

12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. VESTIGIA DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Services will be uninterrupted, secure, error-free, or free of viruses or other harmful components.

13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VESTIGIA OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, OR LOSS OF DATA.

14. Governing Law & Jurisdiction
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the United States of America, without recourse to its conflict of law provisions.
You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in the United States, and you consent to the exclusive jurisdiction of such courts.

15. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If we make changes that are material, we will provide notice by updating the date at the top of these Terms or sending you an email/in-app notification.
By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
